The website Pastamansi.com (“the Site”) is owned and operated by Pastificio Mansi (“we”, “our” or “us”).
The below constitutes a legal agreement between us and a visitor (“you”) with regards to the terms of our website and service.
When registering or transacting on our website, you must check the box to confirm your acceptance of this agreement.
In doing so, you represent that you (a) have read, understood and agree to be bound by this Agreement and (b) are aged 18 years or over. If you are entering into this agreement as a guardian or parent on behalf of your child, please be aware that you are fully responsible for their use of this Site and any legal liability incurred.
This Agreement (along with any other documents or terms referred to) represents your entire agreement with us with respect to your use of our Site. If any item or section of this Agreement is held unenforceable or null, that item or section shall instead be interpreted, as closely as possible, in a fashion consistent with the applicable law to reflect the original intentions of the parties.
All other items and sections will remain in full effect.
If you are unable to agree or comply with any of the terms or conditions in this Agreement, do not tick the box to accept these when registering or transacting, and please either contact us for clarification or do not attempt to use the Site.

1.1All orders requested are subject to acceptance by PASTIFICIO MANSI and only PASTIFICIO MANSI, reserve the right, at our absolute discretion, to reject any order without giving reasons. In the event of rejection, we will refund or cancel any payments received in full, via the payment method used to place the order.
1.2Your order constitutes a request to us to buy a Product(s). Full payment for both the Product and any delivery fee(s) is required at the point of the transaction. This payment represents a legally binding agreement to the terms set out here.
1.3Once the order is completed, you will receive an Order Confirmation email from us. This confirms that we have received your order and it has been accepted.
1.4It is your responsibility to check the Order Confirmation to ensure that the order details are correct. This includes the items ordered, the date, address for delivery, recipient’s phone number and any specific delivery information. If you do not receive an Order Confirmation, please first check your junk folder as it might be redirected there by your security software. If not there, please contact us directly to enquire.
1.5If you notice an error in your Order Confirmation, you must notify us immediately, within 24hours.
1.6Any delivery charge will be added to the total amount during the payment process, before completion of your order.
1.7Prices are liable to change at any time, however these changes will not impact any order where an invoice has already been sent/paid.
1.8All the orders have to be placed by midday of Wednesday, deliveries will be done in between 1pm and 7pm on Friday.
1.9If you wish to change your order, please do so contacting us at email@example.com or by phone at +44 (0)78 9194 2757. We’ll always do our best to make last-minute changes for you, but we can only guarantee changes that are requested on the same day the order has been placed. The order has to be considered changed once the Customer Service team confirms the order change to you.
1.10If you are unlikely to be home during our delivery slot, please specify an alternative delivery address, (i.e. work, a relative, neighbour etc). Please be aware that because you order a fresh/chilled product, we do not recommend delaying delivery or leaving it out of the fridge for a long time as this will break the chill chain and we will be unable to accept any return of such product.
The Products are produced fresh on the day of delivery to, or collection by, you and will remain fresh for the remainder of that day. We will not be liable for any deterioration caused by these not being consumed within that time frame.
The Products must be kept at 3C/ 5C temperature in their box/bag until consumed. We are not liable for any deterioration caused by the Products being incorrectly stored in any fashion including, but not limited to, refrigerating or freezing.
1.11Where you fail to collect your Products on the requested day of collection or where no one is present and/or available to receive delivery on the requested day for delivery, the Products will then be spoiled and no replacement will be offered.
1.12Once the Products have either been collected from our store or delivered to the requested address, we are no longer liable or able to take responsibility for any damage caused by you or the person, courier or agent engaged by you to collect or receive delivery from us. We recommend that you (or the person/courier/agent) check the items before leaving the store/accepting delivery.
1.13We are not liable, under any circumstances, to you with regards to any complaint regarding any aspect of any Product if not raised to us within 24 hours of collection or delivery of the Product.
INSPECTING YOUR GOODS
2.1You should inspect all purchased products upon receipt and check that everything specified on the delivery note is included. You will be deemed to have accepted the order unless you notify us upon receipt that there is a problem immediately and/or you return the goods in accordance with our Returns Policy if such return is permitted. If you fail to take such action, we are not obligated to accept any rejection by you of the merchandise at a later date. Your statutory rights are not affected.
2.2In the event that items listed on the Delivery Note do not match those contained in your parcel; or goods are received damaged or faulty in any way, please notify us immediately.
2.3Our pasta and sauces are freshly made before delivery. If the food we deliver to you does not seem fresh, please contact us at firstname.lastname@example.org to let us know. If, at our sole discretion, the food does not meet our high freshness standards, we will give you the choice of a free replacement at our next available delivery date, or a refund. Please note that you will need to email us a photo of the un-fresh food within 24 hours of receipt in order to be eligible for a refund. If we offer you a refund, we will refund you the full amount within 3 days. Please note that banks might take an additional 3-5 days to refund the amount to your card.
2.4While our Pasta is packed carefully to ensure it arrives in perfect condition, on occasion (and for reasons beyond our control) damage may occur in transit. Should this occur to a level that you deem unacceptable, please contact us so that we can arrange a free replacement at our next available delivery date, or a refund. Please note that you will need to email us a photo of the damaged products within 24 hours of receipt in order to be eligible for a refund. If we offer you a refund, we will refund you the full amount paid for the damaged items within 3 business days. Please note that banks might take an additional 3-5 days to refund the amount to your card.
2.5Due to the perishable nature of our fresh pasta, we are unable to accept returns. We offer our customers refunds or replacement delivery if our orders are not delivered to an acceptable quality, as detailed above.
3.1You may have the legal right to cancel your order within 3 working days from the date of receipt of the goods if you send us a Notice of Cancellation in writing and return the goods to us in their original, unopened and unused condition. You can submit your Cancellation Notice by emailing us at email@example.com.
3.2The Distance Selling Regulations do NOT apply to orders of fresh or chilled items and you will have no right to cancel orders for these products. However, if you send us an email to firstname.lastname@example.org of the same day you have placed your order we will do our best to help you.
4.1All items are subject to availability. Validly stated prices on our website remain in effect for so long as the merchandise is available or as otherwise stated on our website. We will inform you as soon as possible if the goods you have ordered are not available for purchase.
5.1Please remember that when we accept your submitted order for merchandise on this website, there will be a legally binding contract.
6.1Any contracts entered into as a result of usage of this website are governed by English law. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English. These Terms & Conditions of Sale do not affect your statutory legal rights.
6.2The purchase of products through PASTIFICIO MANSI website is strictly limited to parties who can lawfully enter into and form contracts on the website in accordance with English law.
7.1We reserve the right to change these Terms & Conditions of Sale from time to time and we encourage you to review them as often as possible. Any changes are effective immediately upon posting to the website.
8.1All prices are displayed including VAT and exclusive of delivery charges. The total cost of your order is the price of the merchandise and delivery charges as set out in the Delivery Charges.
8.2PASTIFICIO MANSI does not price-match with other retailers. We do, however, consistently work towards maintaining competitive prices on all products. All prices are stated inclusive of any applicable VAT, unless otherwise stated. All applicable delivery charges are set out explicitly in your order.
9.1Although unlikely, the packaging on some products may vary from that shown. The weights and dimensions are approximate. We make every effort to display as accurately as possible the colours and shades of all products that appear on the website. However, as the actual colours you see will depend on your personal computer equipment, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the merchandise on delivery.
10.1Payment can be made using the payment methods detailed in the Checkout section of this website.
10.2Payment will be debited from your account at the point at which your order is processed/dispatched.
10.3By entering these payment details at checkout you confirm that the credit or debit card being used is yours. Please note that all credit/debit cardholders are subject to validation checks and authorisation by the issuer of the card.
10.4If the issuer of your payment card refuses to pay or does not for any reason authorise payment to PASTIFICIO MANSI, we will not be liable for any delay or non-delivery of merchandise.
10.5You represent and warrant that the payment details you provide on ordering each time are both valid and correct and you confirm that you are the person referred to in the billing information provided.
10.6We retain the legal ownership of all products until full payment has been made by you and received by us and legal ownership of the products will immediately transfer back to us if we refund any payment for the products to you.
ACCESS TO OUR SITE
11.1We are not, and will not, be liable if, for any reason, the Site is unavailable for any period, and we reserve the right to amend, restrict or withdraw any service provided on the Site without notice.
PLACING AN ORDER
11.2Orders are processed through Stripe.com

11.6If you notice an error in your Order Confirmation, you must notify us immediately for same day orders or prior to the order cut-off times for advance or catering orders. Please note that we cannot guarantee any amendment for same day orders and that no amendment has been made to any order until confirmed in writing by us.
11.7We cannot accept responsibility for any errors made during the ordering process and for the impact that this may have on your order.
11.8Your purchase cannot be confirmed until payment in full for the Products ordered has been received by us, unless explicitly agreed to by us in advance.
11.9As some of our Products and/or flavours are seasonal and so subject to change, in any instance where a Product/flavour is no longer available, we will contact you to advise and offer an alternative.
11.10As all payments made by credit or debit card will be subject to relevant validation checks and authorisation by the card issuer, if the issuer refuses to authorise payment for any reason, we are not liable for any delay or non-delivery of the order.
11.11We will not store your credit or debit card details anywhere on the Site.

13.1No failure to exercise and no delay on the part of PASTIFICIO MANSI in exercising any right, remedy, power or privilege of PASTIFICIO MANSI under these terms & conditions and no course of dealing between you and PASTIFICIO MANSI shall be construed or operate as a waiver, nor shall any single or partial exercise of any right, remedy, power or privilege preclude any other or further exercise thereof or the exercise of any other right, remedy, power or privilege on the part of PASTIFICIO MANSI.
